October 1st 2019 a judgement by the German court of law ruled that consent by a pre-checked checkbox (opt-out) is not GDPR compliant.
Instead, we - in close corporation with our own and some of our customers' legal advisers - have implemented a new default consent procedure that does not track the user, until explicit consent has been given.
We have upgraded our GDPR implementation on iOS and Android. Following a walk-trough of the solution on each of the three platforms.
Please Note: Screenshots in this article are not from the final stage of development, so changes in design may occur. The concept will remain the same.
The new GDPR solution on ANDROID
Step 1: After updating or installing the app, the user will see a consent pop-up, when he/she opens the app. This pop-up contains information about tracking, a link to your Privacy Policy, and the opportunity to accept or decline to be tracked. No data is collected at this point.
Step 2a: Pressing "Accept" will activate tracking and close the consent pop-up.
Step 2b: Pressing "Decline" will activate a manage window
Step 3: The manage window allows the user to turn on/off tracking (by default turned off) and save his/her preferences.
Step 4: Privacy Settings are available in the settings menu within the app (burger menu), making it possible for the reader to withdraw consent by turning off tracking at any time.
As soon as the user has either accepted or declined the terms, the consent pop-up will not be shown again. It is not possible to ignore the consent pop-up.
The texts in the consent pop-up and in the manage window are customizable with a limit of approximately 550 characters (depending on line shifts)
